O Supremo Tribunal Federal (STF) confirmou que o Corinthians terá de pagar multa de mais de R$ 8 milhões ao atacante Gustavo Mosquito pela rescisão de contrato. O julgamento, em plenário virtual da 1ª Turma, terminou com o placar de 4 a 0 pela manutenção da decisão em instância anterior. Alexandre de Moraes, único corintiano da corte, votou contra o clube.
Mosquito (ou Gustavo Silva) rescindiu judicialmente seu contrato com o Corinthians em julho do ano passado. O atacante reclama atraso no pagamento do FGTS (Fundo de Garantia por Tempo de Serviço) e de direitos de imagem. A decisão foi proferida pelo Tribunal do Trabalho da 2ª Região, após o pedido ser negado em primeira instância.
O Corinthians também foi condenado a pagar a Mosquito pelo restante do contrato. De acordo com o próprio clube, ao recorrer ao STF em maio, o valor superava R$ 8,3 milhões após juros e correção monetária.
Alexandre de Moraes foi o primeiro a votar, menos de quatro horas depois de o plenário ser aberto. Na sexta-feira passada, ele acompanhou o relator, rejeitando os argumentos do Corinthians, sem justificar o voto. Flávio Dino e Cármen Lúcia também votaram contra o agravo.
Clube queria que a reclamação trabalhista e a execução da multa fossem suspensas até STF decidir sobre pejotização. Em uma decisão recente, o ministro Gilmar Mendes determinou a suspensão de tramitação de todos os processos sobre o tema. Corinthians entende que é o caso da ação de Mosquito, que recebia seus direitos de imagem a partir de uma empresa em nome dele, não da pessoa física.
Pedido do Corinthians foi inicialmente rejeitado pelo relator Cristiano Zanin, em 1º de agosto. O ministro destacou em sua decisão que a multa aplicada pelo TRT2 não tem relação com os direitos de imagem atrasados e que o processo não trata de pejotização. A multa, segundo apontou, é composta pelo valor dos salários devidos da rescisão em 4 de julho de 2024 até o fim do contrato em 30 de junho de 2026, além de 13º e férias proporcionais.
O Corinthians recorreu e o caso foi pautado para o plenário virtual da primeira turma do STF, onde Zanin apresentou seu relatório rejeitando o agravo regimental. No voto, ele criticou o clube, sem citá-lo (o Corinthians aparece citado só em sua sigla SCCP no processo): “A intenção do agravante é utilizar a reclamação como sucedâneo recursal, finalidade essa que não se compatibiliza com a sua destinação constitucional”.
